Q. What is Assault with a Weapon?

Attacking another person with a weapon by force or threat of coercion without their accord or any legal justification is ‘Assault with a weapon.’

Assault with a Weapon is an extensive criminal offence category. It also includes ‘Begging for money’ while carrying a weapon. For instance, the crime of assault with a weapon is where a person uses a weapon as a tool with respect to the force.

Assault with a weapon includes waving a knife in the direction of a person, pointing a firearm, or striking another individual with an object and so on. Even a threat of using a weapon is an offence conceivably punishable by imprisonment.

Q. What is considered a ‘Weapon?’

Technically, anything that is used to attack a person can be counted as a weapon. The most common examples are guns, knives, or clubs. However, some people have been charged with the offence of threatening or striking another person with snowballs, frozen turkeys, loaves of bread and even water.

What is the punishment for Assault with a Weapon?
This kind of an act is considered to be a grave offence. The penalty for this kind of a serious crime is, therefore, pretty severe. The maximum sentence for assault with a weapon is ten years in prison under section 267 of the Criminal Code of Canada.

267. Assault with a weapon or causing bodily harm

267: Every one who, in committing an assault,
(a) carries, uses or threatens to use a weapon or an imitation thereof, or
(b) causes bodily harm to the complainant,

is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years or an offence punishable on summary conviction and liable to imprisonment for a term not exceeding eighteen months.
